Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Cevat Akdemir, an individual developer based in the Republic of Türkiye (“we”, “us”), covering your use of HabitGrid (“the App”). By downloading or using the App you accept these Terms. If you do not accept them, do not use the App.

These Terms sit alongside Apple’s Licensed Application End User License Agreement, which also applies to the App as a minimum. Where these Terms give you more than Apple’s standard agreement, these Terms apply. Where they conflict on a point Apple’s agreement requires, Apple’s agreement applies.

Your licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use one copy of the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and Apple’s Usage Rules. The App is licensed to you, not sold.

You keep all rights in the content you create in the App. We claim no ownership of it and, as explained in the Privacy Policy, we do not receive it.

You are responsible for your own content and for keeping your own copies of anything you would not want to lose. The App is not a backup service.

Purchases and subscriptions

The App offers optional paid features. All purchases are made through Apple’s App Store and are billed to your Apple Account. Prices are shown in the App before you confirm, in your local currency, and may vary by region.

A subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before it ends. Your Apple Account is charged for renewal within 24 hours of the end of the current period, at the price then shown for your plan. You can manage or cancel a subscription at any time in Settings → [your name] → Subscriptions on your device. Cancelling stops the next renewal; it does not end the period you have already paid for.

Where a free trial is offered, any unused part of it is forfeited if you buy a subscription during the trial.

Refunds are handled by Apple, not by us, under the App Store Terms of Service. Request one at reportaproblem.apple.com. We will help where we can, but we cannot issue App Store refunds ourselves.

Availability and changes

We may change, suspend or discontinue the App or any of its features, and may release updates that add, alter or remove functionality. We aim to give notice of a significant change where it is practical to do so. The App requires a compatible version of iOS, and some features require a working internet connection or a service provided by a third party, which we do not control.

Disclaimer

To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any defect will be corrected.

HabitGrid is a general-purpose tool. It does not provide medical, legal, financial or other professional advice, and it should not be relied on as a substitute for a qualified professional.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits or goodwill, arising out of your use of or inability to use the App. Our total liability for all claims relating to the App is limited to the greater of the amount you paid us for the App in the twelve months before the claim, or US$50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the statutory rights your local law gives you, and nothing here overrides them.

Apple’s role

These Terms are between you and us, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim that the App infringes intellectual property rights, and for any product liability or legal compliance claim relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

These Terms apply until terminated. You may end them at any time by deleting the App. We may end them if you materially breach them. On termination you must stop using the App and delete it. The sections on disclaimers, limitation of liability and governing law survive.

Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules, and the courts of Istanbul, the Republic of Türkiye have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in your local courts.

General

If any provision of these Terms is found unenforceable, the rest remain in force. Our not enforcing a provision is not a waiver of it. These Terms are the entire agreement between you and us about the App, together with the Privacy Policy and Apple’s agreement referenced above.

We may update these Terms. The effective date at the top of this page shows when they last changed; continuing to use the App after a change means you accept the updated Terms.
